During a hearing in First Judicial District Court in Santa Fe Friday morning before Judge Anastasia Martin, prosecutors Kent Wahlquist and Elizabeth Counce and defense attorney Thomas Clark stipulated conditions of release for Tim Pacheco, 63, of Los Alamos, in a case involving 28 counts of Criminal Sexual Penetration in the first degree.
The charges were filed by Los Alamos Police Det. Ladislas Szabo May 7 and are related to alleged incidents between 1986 and 1995 involving two male juveniles.
Wahlquist told the Court Friday that the conditions of release would have to be very strict and would include house arrest on electronic monitoring without permission to work. No contact with any children, include Pacheco’s own children would be allowed, including through social media. Wahlquist said it is his understanding that Pacheco will occasionally get online and like the children’s posts. Another stipulation would be that Pacheco could not have any internet access and no contact with anyone who may testify, including the alleged victim.
Clark clarified for the Court that Pacheco lives alone, that he has a girlfriend that lives across the street but that she has no children. He said the girlfriend is perhaps a character witness but is not a witness in the case. Clark acknowledged that one of Pacheco’s daughters is involved in another case involving Pacheco and asked that Pacheco be allowed contact with his two other children through CYFD as approved by therapists and counselors. Wahlquist responded that such contact had not been discussed, adding that state would not stipulate to allowing contact with any of the children.
In pronouncing the conditions of release, Judge Martin told Pacheco that she could not be any more clear.
“No contact means absolutely no contact; no social media contact, don’t send letters, don’t write posts – no contact with the alleged victim of witnesses tat will testify in this case. Additionally, you are not to have any sort of contact with anyone under the age of 18, and again, I can’t be any more clear about no contact. No contact means absolutely zero contact and again that means absolutely no social media contact, no third party contact, and no written contact. Absolutely no contact. Liking a post is something the Court would consider contact,” Judge Martin said.
She also told Pacheco he can’t have internet at his house and he can’t go somewhere and connect to Wi-Fi.
“You are not allowed to access the internet in any way. You’re going to be placed on electronic monitoring and you’re going to be on house arrest. You are to be hooked up with electronic monitoring prior to your release. House arrest means house arrest. You’re not going to the store. You’re not going to the gas station. You’re not even going across the street to your girlfriend’s residence. You’re on house arrest in your house,” Judge Martin said.
Pacheco will be allowed to go to medical and counseling appointments, meet with his attorney and go to his court appearances as long as he obtains prior approval at least two days in advance.
Pacheco has two other pending cases: A Los Alamos County case with three counts of abuse of a child and an Albuquerque case charging him with criminal sexual penetration of a minor.
