District Judge To Hear Pretrial Detention Motion Tuesday For Patrick Fleming

First Judicial District Judge Jason Lidyard is scheduled hear a pretrial detention motion and preside over a preliminary hearing Tuesday morning for Patrick Fleming, 42, of Los Alamos on charges of assault with intent to commit a felony against a household member, attempt to commit a felony (criminal sexual penetration in the first degree), and battery against a household member.

Assistant District Attorney Heather Smallwood filed the pretrial detention motion based on the charges involving extreme violence, Fleming allegedly admitting to attempted criminal sexual penetration, Fleming’s alleged statement to police that he “kind of had an out of body experience” and the nature and seriousness of the danger Fleming could pose to the victim and the community.

The charges were filed in Los Alamos Magistrate Court and bound over April 28 by Magistrate Judge Alexandra Naranjo.
