Michael Fry, 59, of Los Alamos was arrested Thursday and charged with two counts of aggravated assault with a deadly weapon following an incident where he allegedly waved a pistol at men working across the street from his home and at one point aimed it at one of the men.
Los Alamos Police Cpl. Jemuel Montoya spoke to the two men who told him Fry was holding a pistol in his hand and showing it to them by waving it over head while yelling at them to stay away from his property. Court documents indicate one of the men reported that when he looked at Fry, Fry took aim at him and that he ducked and warned the other workers to watch out. The man told Montoya he was scared and believed he was going to be shot.
When Montoya made contact with Fry, Fry stated he was out on the street and that he did have a handgun when he was yelling across the street at the two men. A Ruger .45 cal pistol was recovered and identified by Fry to be the pistol used during the incident.
Fry appeared before Los Alamos Magistrate Judge Pat Casados Friday morning and was placed on pretrial conditions of release. A status hearing has been set for July 10.
