Heather M. Stanfield, 43, of Los Alamos was sentenced Jan. 30 in First Judicial District Court on charges of driving while intoxicated and abuse of a child. Judge Jason Lidyard granted Stanfield a conditional discharge on the abuse of a child charge and placed her on three years of supervised probation. On the DWI charge, Stanfield was given a 90 days suspended sentence and placed on a year of supervised probation. She was ordered to have alcohol screening and treatment as determined by Adult Probation and Parole, have an ignition interlock device for one year, perform 24 hours of community service, attend DWI school and an ASPEN class at Los Alamos Family Council or a similar class as ordered by APPO. The sentences in the two counts are to run concurrently.
Kevin Herring, 42, of Los Alamos pleaded not guilty Jan. 30 to charges of second offence driving under the influence and child abuse. Assistant District Attorney Kent Wahlquist told Judge Lidyard that Herring has two habitual offender offenses which will add incarceration of four years to the sentence if Herring is found guilty. Wahlquist told the Court that the history and facts in the case indicate a substance abuse issue and asked for conditions of release pending trial that would include a Soberlink. Judge Lidyard asked about prior criminal history and Wahlquist said the two prior cases were for possession of a controlled substance. Herring was released on his own recognizance on pretrial probation conditions which include installation of an ignition interlock device.
Damien Marquez, 25, of Albuquerque pleaded not guilty Jan. 30 to a charge of aggravated battery with great bodily harm. He was released on his own recognizance with standard conditions of release. For one month as part of pretrial probation, he is required to submit to urinalyses twice a week and will be released from that requirement if he tests clean. Wahlquist told the Court that Marquez was “extremely drunk during the incident and beat the severely”. Judge Lidyard asked how Marquez and the victim knew each other and Wahlquist responded that Marquez and the victim happened to have been at a bar at the same time and had a mutual acquaintance.
Alan Wilson, 38, of Albuquerque pleaded not guilty Jan. 30 to 10 counts of criminal penetration of a minor and 20 counts of criminal penetration of a minor. Wahlquist said if found guilty of all charges, Wilson faces a mandatory minimum of 18 years of incarceration and a $250,000 fine. Wahlquist asked that Wilson’s pretrial conditions of release remain the same as those imposed by Judge Lidyard prior to the charges being bound over from Los Alamos Magistrate Court. Those conditions required Wilson to live with his parents in Albuquerque under house arrest.
A bench warrant was issued Jan. 31 by Judge Lidyard for Samuel Herrera, 30, of Santa Fe for failure to appear in court. Herrera is charged with eight counts of forgery of $2,500 or less, one count of larceny over $500 and two counts of unlawful use of a credit card. All 11 charges are fourth degree felonies.
Jury selection is scheduled for Feb. 13 for the trial Nichole Marsh, 38, of Los Alamos who pleaded not guilty to a second degree felony charge of trafficking by distribution of a controlled substance – methamphetamine. A trial date is set for Feb. 22.
