LTE: Request For Council Assistance On Community Broadband Coordination In Quemazon And Hawk’s Landing

To County Manager Anne Laurent and Members of the County Council,

Over the last several years, I believed the County was working toward a practical, negotiated solution regarding existing LANet infrastructure in Quemazon and Hawk’s Landing.

The County’s recent letters make ownership/title and franchise compliance threshold issues, marking a clear shift in approach.

It is disappointing that requests and suggestions we have put forth are not being responded to.

Because the County is treating ownership/title and franchise compliance as threshold issues, there is currently nothing to negotiate. LANet will focus on compliance and addressing the County’s requests.

Given this shift, LANet will retain legal counsel and proceed with provide relevant information to the County’s proposed independent third-party review.

The review should be neutral, with a defined scope and timeline. I appreciate the County’s offer to fund this review at no cost to LANet. We do not consider the results of such a review as binding.

In parallel, LANet will work in good faith to address franchise compliance items, including any catch-up requirements.

Please advise the County’s preferred process for bringing the franchise agreement into compliance and handling any past-due items.

For consistency and transparency, I request that the same standards be applied equally to other providers in these areas (including Xfinity and Lumen) and to any new ISPs participating in the County broadband project, including expectations for as-builts and franchise/ROW documentation.
